Trustbox is committed to full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and related Federal Communications Commission (FCC) regulations. This page explains what the TCPA is, how it protects you, and how Trustbox ensures compliance.
1. What Is the TCPA?
The Telephone Consumer Protection Act (TCPA) is a federal law enacted in 1991 that regulates telemarketing calls, auto-dialed calls, and pre-recorded voice messages. The TCPA was designed to protect consumers from unwanted communications and applies to any person or business that initiates calls to consumers in the United States.
Key protections under the TCPA include:
- Requiring prior express written consent before making auto-dialed or pre-recorded calls.
- Establishing quiet hours during which calls may not be placed.
- Guaranteeing consumers the right to opt out of further communications at any time.
- Imposing penalties of $500 to $1,500 per violation for non-compliance.
2. Prior Express Written Consent
Under the TCPA, Trustbox is required to obtain prior express written consent before placing any AI voice simulation call to a simulation recipient. This is the highest standard of consent under the TCPA.
What "prior express written consent" means:
- Consent must be obtained before any call is placed, not during or after.
- Consent must be given in writing (which includes electronic forms and digital signatures per the E-SIGN Act).
- The consent form must clearly and conspicuously disclose:
- That the person is authorizing Trustbox to place AI voice simulation calls.
- The purpose of the communications (educational scam awareness simulation).
- The approximate frequency of calls.
- That consent is not a condition of purchasing any goods or services.
- Consent must be freely given — a pre-checked checkbox does not constitute valid consent.
How Trustbox obtains consent:
Before a simulation can be initiated, the Trustbox user (the person setting up the simulation) must confirm that the intended recipient has provided explicit consent. Trustbox's consent flow includes:
- A clear consent disclosure displayed to the user, who must confirm that the recipient has agreed.
- An unchecked checkbox that must be actively selected — it is never pre-checked.
- A logged consent record that captures the timestamp, the IP address, the consenting party, and the exact consent language acknowledged.
3. Quiet Hours
The TCPA and FCC regulations prohibit calls before 8:00 AM and after 9:00 PMin the recipient's local time zone.
Trustbox enforces quiet hours automatically. Our system determines the recipient's time zone based on their phone number area code and will not initiate any call outside of the permitted hours. If a simulation is requested during quiet hours, it will be queued and delivered at the next permissible time.
4. Your Right to Opt Out
You have the right to revoke consent and opt out of receiving Trustbox simulation calls at any time. There is no penalty for opting out.
How to opt out:
- By email: Send an opt-out request to support@trustboxai.com with the phone number you want removed.
- By phone: Call us and request removal of your phone number.
Once you opt out, we will process your request within 10 business days as required by the TCPA. No further simulation calls will be placed to the opted-out number. You will receive a one-time confirmation email acknowledging your opt-out.
5. How Trustbox Maintains Compliance
We take TCPA compliance seriously. Here is a summary of our compliance measures:
Consent Management
All consent records are stored with timestamps, IP addresses, and the exact language that was acknowledged. Records are retained for at least 5 years.
Do-Not-Call List
We maintain an internal do-not-call list. Any phone number that has opted out is permanently blocked from receiving further simulations. This list is checked before every call is placed.
Quiet Hours Enforcement
Calls are automatically blocked outside the 8:00 AM to 9:00 PM window in the recipient's local time zone. No manual override is available.
Telnyx Telephony
Trustbox uses Telnyx for voice call delivery. Telnyx provides carrier-grade call routing with 97% answering machine detection accuracy.
6. Call Frequency
Trustbox places calls only as part of an educational simulation that you (or someone with your consent) have initiated. There are no recurring calls. Typical usage is 1 call per simulation (up to 3 retry attempts if unanswered).
7. State-Specific Regulations
In addition to the federal TCPA, several states have enacted their own telemarketing and consumer protection laws that may impose stricter requirements. 8. Filing a Complaint
If you believe Trustbox has violated the TCPA or your rights as a consumer, you may:

- File a complaint with the Federal Trade Commission (FTC).
- Consult with a private attorney, as the TCPA provides a private right of action with statutory damages of $500 to $1,500 per violation.
