1. Acceptance of Terms

By accessing or using Trustbox ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of the Service

Trustbox is an educational simulator designed to help families recognize and resist AI voice cloning scams. The Service creates temporary AI-cloned voice simulations that replicate real-world scam patterns in a safe, controlled environment.

Trustbox is not a security product, telecommunications service, fraud detection system, or law enforcement tool. It is an awareness and education tool only.

3. Eligibility

You must be at least 18 years of age to create an account and use Trustbox. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You must notify us immediately at support@trustboxai.com if you suspect unauthorized access to your account.

5. Consent and TCPA Compliance

Before initiating any simulation, you must obtain and provide prior express written consent from the person who will receive the simulation call, as required by the Telephone Consumer Protection Act (TCPA). This means:

• You must inform the recipient that they will receive an AI voice simulation call from Trustbox for educational purposes.
• The recipient must explicitly agree (consent cannot be assumed or pre-checked).
• You are solely responsible for ensuring that valid consent exists before starting a simulation.

6. Acceptable Use

You agree to use Trustbox only for its intended educational purpose. You may NOT:

• Use the Service to harass, intimidate, threaten, or deceive any person beyond the scope of the educational simulation.
• Initiate simulations targeting individuals who have not provided prior consent.
• Use the Service to impersonate others for fraudulent, malicious, or illegal purposes.
• Attempt to extract, download, or retain the AI-cloned voice audio beyond the simulation.
• Reverse-engineer, decompile, or attempt to extract the source code of any part of the Service.
• Use the Service in violation of any applicable law, including but not limited to the TCPA, state telemarketing laws, or wiretapping statutes.
• Resell, sublicense, or commercially exploit the Service without our written permission.

7. Voice Data and Intellectual Property

You retain ownership of the voice recordings you upload. By using the Service, you grant Trustbox a limited, temporary license to process your voice recording solely for the purpose of generating the educational simulation. This license terminates automatically when the voice data is deleted (within 24 hours).

All other content, design, code, trademarks, and intellectual property associated with Trustbox remain our exclusive property.

8. Payments and Refunds

Trustbox charges $9.90 per simulation. There are no subscriptions or recurring charges. Payments are processed by Stripe. You agree to Stripe's Terms of Service when making a purchase.

If a simulation fails after 3 retry attempts due to the recipient being unreachable, a full refund is automatically issued. Prices are listed in US Dollars and may change with 30 days' prior notice.

You agree to indemnify and hold harmless Trustbox from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Service; (c) your failure to obtain proper consent from simulation recipients; or (d) your violation of any applicable law.

12. Account Termination

We may suspend or terminate your account at our sole discretion if we believe you have violated these Terms, including but not limited to:

• Initiating simulations without valid recipient consent.
• Using the Service for harassment, fraud, or any illegal purpose.
• Attempting to extract or misuse AI-cloned voice data.
• Creating multiple accounts to circumvent bans.

Upon termination, your right to use the Service ceases immediately. We will delete your voice data promptly. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) will continue to apply.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in the State of Delaware, and the arbitrator's decision shall be final and binding. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
